A US Grand Jury - which investigates if there is enough evidence for a trial- is now understood to be investigating the actions of mobile advertisingagencies to see if they are breaching privacy laws. The revelation came from anSEC filing by Pandora Media which is currently in the process of floating itsshares on the stock exchange.According to the SEC filing, the company was approached earlier this year tooffer testimony to the Grand Jury, although it added that it is not a specifictarget of the investigation.The company offers an advertising funded mobile music service."In early 2011, we were served with a subpoena to produce documents inconnection with a federal grand jury, which we believe was convened toinvestigate the information sharing processes of certain popular applicationsthat run on the Apple and Android mobile platforms," the company said.It noted that privacy groups and government bodies have increasinglyscrutinized the ways in which companies link personal identities and dataassociated with particular users or devices with data collected through theinternet, and they expect such scrutiny to continue to increase.The company warned that if new regulations come into effect as a result ofthe investigation, then it might be bound by contractual obligations that limitits ability to collect, use, disclose, and leverage listener data and to deriveeconomic value from it.In particular, government regulators have proposed "do not track"mechanisms, and requirements that users affirmatively "opt-in" to certaintypes of data collection that, if enacted into law or adopted by self-regulatorybodies or as part of industry standards, could significantly hinder itsability to collect and use data relating to listeners.
A new Mobile Premium Services Industry Code, announced today by Australia'stelecoms regulator, the ACMA, providestougher rules for the advertising andprovision of premium rate SMS and MMSservices for mobile phone users. It iseffective from 1 June, 2012.The previous code was put in place on 1 July2009 to address customer complaints about mobile premiumservices. While complaints have fallen 90 percent from their peak, requirements in the newcode will make the prices, terms andconditions of these services even clearer toconsumers.The new code also introduces a requirementfor mobile carriers to monitor and report tothe ACMA on content providers" compliancewith the code."While complaints about these services havedramatically reduced, the ACMA requiredindustry to take additional steps to furtherprotect consumers from rogue operators," saidACMA Chairman, Chris Chapman."These new rules are designed to make it muchharder for mobile premium service providersto mislead customers. The new compliancereporting requirements should also make theindustry more accountable to the ACMA and itscustomers."Key measures contained in the new codeinclude:subscription service providers willbe required to use the terms 'subscription"or 'subscribe" in sign-up messages, to informcustomers of the ongoing nature of theseservices and related chargesproviders of reverse charge serviceswill be required to inform customers of callcosts, terms and conditions before chargingthe requirement that informationabout the cost of a service be printed closeto the number used to request a service in anadvertisement.The ACMA can direct service providers tocomply with code obligations. Non compliancemay lead to proceedings in the Federal Courtfor the recovery of a pecuniary penalty of upto $250,000.The MPS Code operates in conjunction with twoservice provider determinations previouslyintroduced by the ACMA which give customersthe choice to bar access to all mobilepremium services and require all serviceproviders to be listed on an industryregister. The ACMA is currently reviewing theoperation of these rules to ensure they areeffective.
